New Bill Could Make “Excessive Cannabis Use” a Crime

Arizona bill could make “excessive” marijuana smoke a misdemeanor, even at home.

A proposed bill in Arizona, SB1725, introduced by state Senator J.D. Mesnard, would treat “excessive” marijuana smoke and odor as a public nuisance if it’s considered to create a condition that endangers the safety or health of others, including in residential settings.

If enforced, the bill could result in a Class 3 misdemeanor. Mesnard told 13 News the proposal is meant to address complaints from neighbors and concerns about marijuana smoke near children, and noted it was inspired by his own experience smelling marijuana smoke outside his home.

In this segment, MITA Founder Demitri Downing argues the language is too vague and too broad, raising questions about what qualifies as “excessive” and how much access it could give the government into private homes. Downing also said he’s especially concerned about how it could impact people who use cannabis therapeutically or medically.

⚠️❗️ Call your legislator: Industry members and citizens who are concerned about their civil liberties should contact their legislators in their district and urge them to vote NO. This is an unnecessary bill that infringes on personal freedoms, expands the power of government through vague definitions, and could lead to unintended consequences. When government acts, it should act intelligently, specifically, and with purpose, not just to send some abstract message.
